Washington/DEP working on consent agreement

WASHINGTON TWP. -The Washington Township Municipal Authority is considering a proposed consent order offered by the state Department of Environmental Protection concerning its sewerage system.

Freda Tarbell, DEP spokesperson for the agency’s Meadville office, said the WTMA’s system is hydrologically overloaded and the WTMA must resolve the problem.

“The system regularly violates its established (discharge) limits,” explained Tarbell.

Tarbell would not disclose what the proposed agreement contains.

“The DEP and the WTMA have been in discussions for a number of months,” said Tarbell. “The proposed consent order is a draft document so I really can’t get into it.

“Until something is finalized, it’s like an ongoing negotiation.”

Tarbell said the WTMA has until June 13 to respond to the DEP’s proposed order.

Ralph L.S. Montana, legal counsel for the Washington Township Board of Supervisors, said two of the three supervisors, members of the WTMA, DEP and several township residents met March 28 to discuss ongoing sewerage issues.

Montana said he has received a copy of the proposed consent order but has not completely reviewed it.

“There are overflow problems, there is a matter a disturbed wetland area, some general permit issues to be addressed,” said Montana . “The DEP was very congenial. They want to work with the township and the authority to get the system into compliance.”

It was not immediately known if the WTMA faces any fines or penalties, however. Montana said he does not believe any penalties have been levied at this time.
