Farmington moves to condemn right of ways

FARMINGTON TWP.-Farmington Township supervisors July 2 agreed to move ahead with eminent domain condemnations on approximately 12 right of ways needed for a water and sewage line extension project.

Supervisors Gene Frederick and David Crise approved the action. Supervisor Matt Ellenberger was absent from the session.

The right of ways are needed for Phase IV of the project.

Phase IV is expected to include the area around St. Mary’s Church and further north along State Route 66 to include two season camp developments.

The Phase IV water line extension is preliminarily estimated to cost $765,000 while the sewerage service lines are estimated to cost $635,000.

The Phase IV expansion is expected to add about 52 new customers to the system.

Township secretary Nancy Mellon said the property owners facing the eminent domain process have so far refused to sign off on the needed right of ways.

The condemnation process, also known as eminent domain, allows a governmental entity to take privately owned land for projects which benefit the community. In this case, the township is not taking ownership of the land but instead a narrow right of way in which to place the water and sewage service lines.

The owners of the land targeted for taking for service line right of ways would be compensated for the land. That compensation would be determined by an independent appraisal firm after the courts have determined the taking of the property is proper and justified.

In other business July 2, supervisors:

Acknowledged a letter from PennDOT of the agency’s application to the Public Utilities Commission requesting permission to remove the Knox and Kane Railroad crossing along State Route 66 just south of Leeper.

Supervisors noted the crossing has already been removed.

Township road master Francis Allio requested and received permission from the board to inquire if other crossings along township roads also could be removed.

Allio said the crossing along Hagerty Drive is particularly bad, adding two crossings along Kahle Drive and one along Wolbert Drive also are in bad condition.

Allio suggested removing one or two crossings per year if the ownership of the railroad approve.

Formally designated the medical helicopter landing zone at the township park as “Farmington Township Community Park Heliport.”

Briefly discussed options regarding the installation of permanent or improved temporary restrooms at the park. The issue will be discussed further at a board work session later this month.
